idfiCard Trial Subscription Agreement

This Trial Subscription Agreement, including the information submitted upon registration for the Service (“Registration”), governs your use of and access to a limited trial subscription to the idfiCard suite of digital identity services (the "Service").

1. Trial Subscription

Upon your completion of Registration and our acceptance of your request, subject to your compliance with this Agreement, you will be entitled to use the Service for a limited trial period. This may include a complimentary subscription period bundled with the purchase of a physical card or a free trial for new users. To extend your access beyond this trial, you must purchase a paid subscription.

2. Physical Cards (NFC/QR)

As part of the Service, you may purchase a physical NFC or QR-enabled card (“Physical Card”) to link to your digital profile. The use of a Physical Card is subject to the following terms:

3. Restrictions

Your use of the Service is subject to the following restrictions: (a) You may only create and manage a digital profile for yourself or for an entity for which you have the full right, power, and authority to represent. (b) You may not use the Service for any illegal activities, to impersonate others, or to transmit harmful or offensive content. (c) You may not attempt to reverse-engineer, decompile, or otherwise discover the source code of the Service. (d) You will not remove, alter, or obscure any proprietary rights notices of idfiCard.

4. Ownership and Confidentiality

All intellectual property rights in and to the Service, its design, and its software are owned by idfiCard and its licensors. You retain all ownership rights to the content (text, images, links) that you upload to your profile (“Your Content”). However, you grant idfiCard a worldwide, non-exclusive, royalty-free license to host, display, and transmit Your Content as necessary to provide the Service. We agree to treat your non-public account information as confidential.

5. Right to Display Content

(a) You represent and warrant that you have full right, power, and authority to use and display Your Content on your public profile. You agree to indemnify and hold idfiCard harmless from any claims arising from a breach of this warranty. (b) You acknowledge that making your profile public means Your Content will be visible to anyone who accesses your profile link. It is your responsibility to manage the privacy and accuracy of Your Content.

6. Warranty Disclaimer

THE SERVICE AND ANY PHYSICAL CARDS ARE PROVIDED "AS IS" WITHOUT ANY WARRANTY. IDFICARD EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be error-free, uninterrupted, or completely secure.

7. Limitation of Liability

THIS TRIAL SUBSCRIPTION IS PROVIDED TO YOU FREE OF CHARGE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNDER NO CIRCUMSTANCES SHALL IDFICARD BE LIABLE FOR ANY DAMAGES OF ANY KIND, INCLUDING LOSS OF PROFITS, LOSS OF DATA, OR FOR ANY DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE OR ANY PHYSICAL CARD. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED $100.

8. Termination

idfiCard can terminate this Agreement and your access to the Service immediately upon written notice if we reasonably believe you have breached this Agreement. Upon termination, your right to use the Service will cease, and your public profile will be unpublished.

9. General

This Agreement is governed by the laws of India, and any disputes will be subject to the exclusive jurisdiction of the courts in Sangli, Maharashtra. This document constitutes the entire agreement between you and idfiCard regarding the trial use of the Service.
